Swiftway AI LLC (“Swiftway,” “we,” “us,” or “our”) operates the Swiftway platform (the “Service”), a software-as-a-service application that helps construction trades and services manage estimates, orders, invoices, scheduling, and client communications. This Privacy Policy explains what information we collect, how we use it, and the choices you have about it.
By creating an account or otherwise using the Service, you agree to the collection and use of information in accordance with this policy.
1. Information we collect
Information you give us directly
- Account information: name, email address, username, password (stored as a salted hash), profile photo, role, and the organization you belong to.
- Phone number: when you opt in to messaging features, we collect and verify the mobile number you provide and store it associated with your account.
- Business data: records you create within the Service — clients, projects, estimates, orders, invoices, change orders, payments, time entries, vendor information, contacts, properties, uploaded documents, photographs, and notes.
- Communications content: the body of text messages, emails, and chat messages you send to or through the Service, including content captured via SMS for AI processing (notes, reminders, actions).
- Payment information: billing details for paid plans, processed by our payment provider. We do not store full card numbers on our servers.
Information collected automatically
- Usage data: pages and features accessed, actions taken, timestamps, and approximate device/browser information.
- Log data: IP address, request method/path, response status, and error traces, retained for security and debugging.
- Cookies and similar technologies: session cookies for authentication and a small set of functional cookies for preferences.
2. How we use your information
- To provide, operate, and maintain the Service.
- To authenticate users and protect accounts.
- To deliver text messages, emails, and notifications you have requested.
- To process content you submit through AI-assisted features (estimate generation, document parsing, note classification, scheduling, reporting). Content sent for AI processing is transmitted to our model providers strictly for that purpose and is not used to train their public models.
- To respond to support requests and improve the Service.
- To detect, investigate, and prevent abuse, fraud, or security incidents.
- To comply with legal obligations.
3. SMS / text messaging program
When you bind your phone number to your Swiftway account, you consent to receive SMS text messages from Swiftway related to your use of the Service, including: confirmations of captures, reminders you set, clarifying questions, status updates on your records, and account-related notifications. Message frequency varies based on how you use the Service.
Standard message and data rates may apply based on your mobile carrier plan. We do not charge you separately for messaging.
You can opt out at any time by replying STOP to any message we send. Reply HELP for assistance. Opting out via STOP suspends all non-emergency messaging to your number; you can re-opt in by replying START or by re-binding your phone in the Service.
We do not sell, rent, or share mobile numbers or SMS content with third parties for marketing purposes. SMS data (your phone number and the contents of messages exchanged with the Service) is used only to operate the messaging features you have requested. SMS opt-in information is not shared with third parties or affiliates for marketing.
4. How we share information
We share information only in the following limited circumstances:
- Within your organization: records and communications you create are visible to other authorized members of your organization based on the roles and permissions configured by your administrator.
- Service providers (sub-processors): we use a small number of vendors to operate the Service, including:
- Cloud hosting and edge compute (Vercel)
- Database hosting (Neon)
- File and image storage (Vercel Blob)
- SMS delivery and verification (Twilio)
- Email delivery (Resend or your connected Google Workspace account)
- AI model APIs (Anthropic) for AI-assisted features
- Legal compliance: when required by law, subpoena, or to protect the rights, property, or safety of Swiftway, our users, or the public.
- Business transfers: if Swiftway is involved in a merger, acquisition, or asset sale, your information may be transferred subject to the same protections in this policy.
5. Data retention
We retain account and business data for as long as your account is active or as needed to provide the Service. Audit logs related to security and SMS delivery are retained for up to 24 months. After account deletion, we delete or de-identify personal data within 90 days, except where retention is required by law (e.g. tax records).
6. Security
We use industry-standard technical and organizational measures to protect your information, including encryption in transit (TLS), encryption of secrets at rest, scoped access controls, audit logging, and regular review of third-party dependencies. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
7. Your choices and rights
- You can review and update most account information from within the Service.
- You can disconnect SMS at any time via the Settings → Integrations → Messaging page or by replying STOP to any message.
- You can request a copy of the personal data we hold about you, or request deletion of your account, by contacting us at the address below.
- If you are in a jurisdiction with additional rights (e.g. California, the EU, the UK), you may have the right to access, correct, delete, port, or restrict processing of your personal data, and to object to certain uses. We will honor verified requests as required by applicable law.
8. Children
The Service is not directed to children under 16, and we do not knowingly collect personal information from children under 16. If you believe a child has provided us with personal information, please contact us so we can delete it.
9. International users
The Service is operated in the United States. If you access the Service from outside the United States, you understand that your information may be transferred to, stored, and processed in the United States and other countries where our service providers operate.
10. Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will revise the “Effective” date at the top of this page and, for material changes, provide notice within the Service or by email.
